In the following
Whoopy Engineering is Whoopy Engineering Ltd. of 5 Victoria Cottages, East End, Newbury, RG20 0AB acting in it's capacity as an Internet Service Provider providing Web Servers and Mail forwarding for its Clients.
Client is the customer of Whoopy Engineering.
User is the person accessing the Web Page or sending or receiving mail to or from a Client.
Service is providing the means for a user to upload the Client's Web Pages, for the Client to update the contents of their web pages on the Server, the provision of Mail forwarding and Spooling on the Server for the Client and the supply of a primary Domain Name Service for the Client's domain using internet protocols. Supplies are the Web Design or Programming provided by Whoopy Engineering specifically for the client.
Server is a Computer or Computers serving the Client's registered Domain, Mail and Web Site.

Guarantee of Service

Whoopy Engineering will endeavour to provide continuous service from its servers but from time to time it may be necessary to suspend operation for maintenance or repair, Whoopy Engineering will attempt to notify clients by eMail in advance of any planned outage. In the event of an equipment failure, it is our intention to have the service up and running within 4 hours on the next business day.

Backups

The Client is responsible for keeping a backup if the original content of a Site or FTP server, Whoopy Engineering cannot be liable for the accidental deletion of material if the user has FTP access.
Whoopy Engineering will maintain backups of some Logs and data collected by CGI scripts.

Limited Liability

Client agrees to indemnify Whoopy Engineering against any financial loss the client may suffer resulting from interruption of service or equipment failure.
In the event that the server is not available for a period of time or there is a loss of Log Files and Mail Messages due to a Hardware failure, Whoopy Engineering will not be held liable for any consequent loss a Client or User may suffer.

Passwords

In order to operate and maintain it's web site and access it's eMail the Client will be issued passwords. It is the client's responsibility to keep these passwords secure and ensure they are not divulged to other persons. If the client believes a password has been compromised, Whoopy Engineering will issue an alternate one.

Copyright

Clients should respect the copyright of original work.
Whoopy Engineering cannot warrant the accuracy of information available in it's clients's Web Sites.

Intellectual Property

It is understood that Web Design and programming supplied for a Client's Web Site remain the intellectual property of Whoopy Engineering. The Client may not alter such supplies or remove any copyright notice without the written permission of Whoopy Engineering.

Acceptable Use Policy

Clients agree to be bound by the conditions of the applicable Domain Name Registration Authority. Clients agree that they will not use the Web Site or Server for any unlawful purpose, including the transmission or storage of any pornographic or indecent material.

Clients warrant that they will not post any defamatory, offensive or abusive material to the server. Whoopy Engineering can suspend the operation of the web site or server if it believes any use of the server or material on the site to be in breach of UK, International, or Internet Law, in particular theUK Data Protection Act 1998 and the Computer Misuse Act 1990.

In the event of a complaint being received, Whoopy Engineering reserves the right to remove part or all of a Client's Web Site from the server.

Terms and Conditions for UK domain names

Clients who intend to register a UK domain should be aware of the terms and conditions of the contract they enter into directly with Nominet the UK domain registry which are listed here on the Nominet Web Site.

Payment

Services are billed in advance for periods of a year unless otherwise stated. Charges will have VAT added at the prevailing rate. Payment will be due within 30 days of an invoice being issued.

Bandwidth or traffic limiting

The quote a client receives for provision of Service will include a statement of the bandwidth or upper traffic limit for the level of service offered, if the amount of traffic to the client's domain exceeds the stated level, it may be necessary to negotiate higher service fee.
